Terms of service
This is the current, effective version of this document and governs your use of Creataly's website and platform. When we make material changes, we update the date shown above and, where appropriate, notify you.
1. About these terms
These Terms of Service govern your use of the Creataly website at creataly.com and the Creataly platform operated by Creataly, Inc. By using the site or signing up for an account, you agree to these terms.

2. Our service
Creataly is a creator-business operating system that connects rosters, deals, campaigns, scheduling, payments, and insights for creator agencies, brands, and creators. The service includes:
- Roster, Deals, Campaigns, Scheduler, Pay, and Insights modules accessed through your workspace.
- A connected inbox and calendar (Gmail and Outlook), internal chat, and an AI assistant and AI-assisted features.
- Creator identity verification through our verification provider.
- Hosted infrastructure, security, and platform updates.
- Email and in-app support for your workspace administrators.
- Documentation, onboarding materials, and product release notes.
3. Account registration
You must be at least 18 years old and authorised to act on behalf of your agency, brand, or business to register a Creataly account. You agree to provide accurate and complete information during registration and to keep your details up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that takes place under your account. Authentication is handled by Clerk. Notify us immediately at hello@creataly.com if you suspect unauthorised access.
4. Pricing and payment
Subscription plans, modules, and add-ons are described on our pricing page at creataly.com/pricing or in the order form we agree with you. Payments are processed securely through Stripe.
- Subscription fees are charged in advance for the period you have selected.
- Renewals occur automatically at the end of each billing period unless cancelled.
- Taxes are added where required by law and shown at checkout.
- Failed payments may result in your workspace being suspended until the balance is settled.
5. Cancellation and refunds
You can cancel your subscription at any time from your billing portal or by contacting hello@creataly.com. Cancellation takes effect at the end of the current billing period and your workspace remains accessible until then.
- Workspace data is retained for 30 days after cancellation to allow export or reactivation, then deleted.
- Subscription fees already paid are non-refundable, except where required by law.
- Activation, onboarding, or one-off setup fees are non-refundable once the related work has started.
6. Your content
You retain ownership of all content you upload to Creataly, including roster records, deal data, campaign briefs, creative assets, and reporting. You grant Creataly a limited licence to host, process, and display that content for the sole purpose of operating the service for you.
You are responsible for ensuring that the content you upload does not infringe third-party rights, is not unlawful, defamatory, or fraudulent, and complies with the contracts you have with creators, brands, and partners.
7. Our intellectual property
The Creataly platform, modules, dashboards, code, design system, brand assets, and documentation remain the intellectual property of Creataly, Inc. Your subscription grants you the right to use the platform, not ownership of it.
You may not copy, reverse engineer, resell, or sublicense any part of the platform without our written permission.
8. Acceptable use
You agree not to use Creataly to:
- Publish or transmit content that is illegal, defamatory, harassing, or harmful.
- Distribute malware, spam, or phishing content.
- Attempt to access another workspace, account, or data without authorisation.
- Interfere with or disrupt the operation, security, or integrity of the platform.
- Resell, redistribute, or use the platform to build a competing service.
- Use the platform in breach of applicable advertising, consumer, or marketing law.
Violations may result in suspension or termination of your account, removal of offending content, and where appropriate, referral to law enforcement.
9. Availability and support
We work to keep Creataly available 24/7 and to minimise downtime, but we do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible.
Support is provided over email and in-app messaging. We aim to respond to enquiries within one business day.
10. Disclaimers and limitation of liability
The platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Creataly disclaims all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by law, Creataly is not liable for indirect, incidental, special, exemplary, or consequential damages, lost profits, lost revenue, lost data, or loss of business arising from your use of the platform.
Our total liability for any claim arising out of these terms is limited to the amounts you have paid us in the 12 months preceding the claim. Nothing in these terms limits liability that cannot be limited or excluded under applicable law, such as liability for fraud or for death or personal injury caused by negligence.
11. AI features
Creataly provides AI features, including an assistant and AI-assisted drafting and insights. AI output is generated automatically, can be inaccurate or incomplete, and is not professional, legal, or financial advice. You are responsible for reviewing AI output before you rely on or send it, and for ensuring your use of it complies with applicable law and any third-party rights. To provide these features we share the content you use them on with our AI processors as described in our Privacy Policy.
12. Connected accounts and third-party platforms
Some features let you connect third-party accounts, such as Google, Microsoft, Meta, Instagram, TikTok, YouTube, and Twitch. When you connect an account you confirm that you are authorised to do so and that you have any consents required, for example from the people whose email, contacts, or messages you access, and you agree to comply with that platform's own terms. Your use of connected data through Creataly is also subject to those platforms' policies, and access may be limited or withdrawn where a platform requires it.
Where Creataly processes personal data on your behalf as part of the service, that processing is governed by our Data Processing Addendum, which forms part of these terms.
13. Changes to these terms
We may update these terms as the platform develops. Material changes will be communicated by email or by a notice in the platform or website. Continued use of Creataly after changes take effect constitutes acceptance.
14. Governing law
These terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods. You and Creataly agree that any dispute arising under or in connection with these terms will be brought exclusively in the state or federal courts located in Delaware, and each party consents to their personal jurisdiction and venue.
